Reactie FFF op de brief van minister Dekker en het onderzoek van de Universiteit van Maastricht

FFF is heel blij met het feit dat minister Dekker een brief over huwelijkse gevangenschap schrijft waarin hij o.a. heeft aangekondigd om een bepaling in het burgerlijk wetboek op te nemen die voorziet dat beide partners meewerken aan de ontbinding van het religieus huwelijk. Dit voorstel heeft FFF in 20122014, (zie ook: A&MR 2014 Nr.02) en in 2017 bepleit en we zijn blij dat ons voorstel nu ook overgenomen en gepresenteerd wordt door Pauline Kruiniger van de Universiteit Maastricht. Hoe lovenswaardig was het geweest als zij ook FFF als bron had genoemd?! FFF moet helaas vaststellen dat het rapport van de Universiteit Maastricht gebaseerd is op slechts drie (!) casestudies en dientengevolge een aantal essentiële zaken mist. Als gevolg daar weer van ontbreken in de brief van de minister beleidsmogelijkheden. We noemen er hieronder heel kort een paar, en voor een nadere toelichting verwijzen wij u naar onze uitgebreide reactie en dit opiniestuk in Trouw.

1. Huwelijkse gevangenschap en vechtscheidingen
2. Voortduring van huwelijkse gevangenschap als gevolg van het ontbreken van een eerlijk proces
3. Gevolgen huwelijkse gevangenschap
4. Suggesties van de Nederlandse politiek die niet onderzocht zijn
5. Rol van het strafrecht (pagina 93 van het onderzoek) versus civielrecht en lijfsdwang
6. Voorlichting vanuit de overheid
7. Apart dialoog met religieuze gemeenschappen en benoemen van geestelijken tot ambtenaar van de burgerlijke stand

We constateren ook dat FFF huwelijkse gevangenschap en andere gerelateerde onderwerpen op de agenda heeft gezet hebben en inhoudelijk onderbouwd heeft, maar dat zij -een door vrouwen uit de doelgroep opgerichte organisatie- niet betrokken wordt bij de beleidsvorming, terwijl het beleid vervolgens door mensen gemaakt wordt die niet uit de doelgroep afkomstig zijn en de dynamiek ook niet als zodanig kennen. Dat gaat ten koste van de kwaliteit van de voorstellen. Het Vrouwenrechtencomité van de VN vroeg al eerder aandacht voor dit verschijnsel en heeft de Nederlandse regering hierop aangesproken. Kamerleden van diverse partijen hebben waardering voor het werk van FFF.  Derhalve voelt FFF zich zeer gesteund met hun verzoek aan minister Dekker om FFF te betrekken in de beleidsvorming en FFF te steunen.

FFF is zich ervan bewust dat zij een uitgesproken plaats inneemt in het debat. FFF is van mening dat het onderwerp huwelijkse gevangenschap (en de hele emancipatie van meisjes/vrouwen uit patriarchale gemeenschappen) alleen effectief aangepakt kan worden, als de overheid een duidelijk beleid voert op het afdwingen van fundamentele rechten voor meisjes/vrouwen uit deze gemeenschappen. Dat betekent dat een dialoog met deze gemeenschappen nooit vrijblijvend en nooit alleen met de (mannelijke) leiders kan zijn.

Femmes for Freedom’s statement regarding the letter by minister Dekker and the research by Maastricht University

FFF is delighted that the minister for Legal Protection, Sander Dekker, in his letter of 26-04-2018 has acknowledged the need for a new provision in the Dutch civil code that provides that both partners will cooperate to enable the dissolution of a religious marriage. This provision has been proposed by FFF in 2012, 2014 en 2017 and we are joyous that Pauline Kruiniger of Maastricht University has adopted this proposal. We would have regarded this adoption as even more commendable, had she quoted us as the source of this provision. During the last six years, FFF has worked tirelessly, together with various members of parliament as well as ministers from past and present governments, to keep the subject of Marital Captivity on the Dutch political agenda. We are saddened to see that despite our joint efforts, FFF is still not regarded as a partner to the various departments responsible for policy development. As a result of this exclusion, the proposed provisions with regards to marital captivity are at risk of losing the connection to the women and men affected. Maastricht University has researched the phenomenon that is marital captivity. However, as the researchers chose to work with a limited number of cases (3), the research report lacks a thorough analysis of the issues at hand. The report, to which the minister refers in his letter, has resulted in a proposed policy that in our opinion is insufficient and incomplete.

FFF has published an extensive response to both the research as well as the letter. In this response we discuss the omissions in the research report with regards to:

  1. Marital Captivity and divorce disputes
  2. Continued marital captivity due to a lack of fair trial
  3. The effects of Marital Captivity
  4. Suggestions made by Dutch MP’s which a have not been researched
  5. Role of the penal code versus civil code and legal constraint
  6. Prevention and information by the government
  7. The consequences of a separate dialogue with religious communities and appointing clergy as official registrar

FFF ascertains that she – a grassroots organisation founded and run by women from the affected communities – is not involved with policy development, whilst the policies are developed by people outside of these communities, that lack knowledge of the inner workings and dynamics of these communities, in effect creating a mismatch between the envisioned policy and the outcome of said policy. The UN Women’s Rights Commission has previously addressed its concerns about this practice to the Dutch government.

FFF realises that she has a prominent position in the debate. We argue that topics such as marital captivity in specific as well as the emancipation of women and girls from patriarchal societies in general can only be dealt with effectively when the government has a clear policy that defends the fundamental rights of these girls and women. To us, that translates to a dialogue with the members of affected communities, not their religious leaders, whom are almost exclusively male. In light of that argument, we are pleased to see that the minister equally rejects the idea proposed by Maastricht University to appoint imams as official registrars. FFF wants to reiterate that we appreciate the efforts by the minister of Legal Protection and all mp’s involved, and that we are ready to take our seat at the table to share the stories of our communities and to discuss effective and efficient policies to end marital captivity.
